1. Who we are
CarPay Rentals (“the marketplace”, “we”, “us”) is operated as part of CarPay. You can reach us at info@kyritech.com. By using the marketplace you agree to these terms.
2. What this service is — and is not
The marketplace is a venue. Independent vehicle operators publish listings, and drivers browse them and send enquiries. That is the whole of what we do.
- We are not a party to any rental agreement between a driver and an operator.
- We are not an agent, broker or representative of either side, and we do not negotiate on anyone’s behalf.
- We do not own, hold, inspect, insure, register or maintain any vehicle listed here.
- We do not collect rent or hold bonds. Money you pay for a rental goes to the operator, under the agreement you sign with them.
- We do not provide legal, financial, insurance or tax advice. Nothing on this site is advice about whether a rental suits you.
3. Listing information is an operator declaration
Every detail shown on a listing — weekly price, bond, minimum term, inclusions, kilometre limits, vehicle year, platform approvals and compliance statements such as VIC Commercial Passenger Vehicle registration or a current NSW pink slip — is supplied by the operator who published it. We do not verify it, and displaying it is not an endorsement, certification or guarantee.
You are responsible for checking everything that matters to you directly with the operator, in person, before you rent. Inspect the vehicle, read the rental agreement, and confirm the insurance position before any money changes hands.
4. Enquiries
When you submit an enquiry you ask us to pass your name, phone number and any email address or message you provide to that one operator, so they can contact you about that listing. We do not sell your details, and we do not pass them to other operators. See our Privacy Policy for the detail.
Sending an enquiry does not reserve a vehicle, form a contract, or oblige either side to proceed. Operators decide who they rent to.
5. Using the marketplace
You agree not to:
- submit false, misleading or automated enquiries;
- use contact details obtained here for anything other than the specific rental enquiry you made;
- scrape, republish or resell listing data, or attempt to interfere with the site’s operation or security;
- use the marketplace for any unlawful purpose or in breach of any rideshare platform’s own rules.
6. Operator obligations
Operators who publish listings are responsible for the accuracy of everything in them, for holding the registrations, insurance and accreditations required in their state, for keeping listings current (pausing or removing a vehicle that is no longer available), and for the rental agreements they enter into. An operator who publishes materially inaccurate information may have their listings removed.
7. Availability and changes
We may change, suspend or remove any listing or any part of the marketplace at any time, including for maintenance. We do not promise the service will be uninterrupted or error free.
8. Liability
Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law that cannot lawfully be excluded.
Subject to that, and to the extent permitted by law: we are not liable for the condition, safety, legality or availability of any vehicle; for the conduct of any operator or driver; for the terms, performance or termination of any rental agreement; for any bond, damage, excess, fine, toll or loss of earnings arising from a rental; or for indirect or consequential loss. Any liability we do have is limited to re-supplying the marketplace service to you.
9. Disputes between drivers and operators
A dispute about a vehicle, a bond or a rental agreement is between the driver and the operator. We are not an arbiter and cannot compel either side to act. If you believe a listing is misleading, tell us at info@kyritech.com and we will review it.
10. Governing law
These terms are governed by the laws of Victoria, Australia, and the courts of that state have non-exclusive jurisdiction.
11. Changes to these terms
We may update these terms. The version published here at the time you use the marketplace is the one that applies, and the date at the top shows when it last changed.
